Hello Strata Terms of Service

Introduction 

Hello Strata provides the online communications platform at hellostrata.com. 

Upon creating a user account for hellostrata.com you signify your acceptance of the terms of service outlined in this document in order to sign in and use the website.  In this agreement:

Hello Strata is referred to as we, our, or us;  

  • You as the user of Hello Strata is referred to as you and your; 

  • Your owners corporation, body corporate or strata company (terminology varies by Australian state or territory) is referred to as your strata plan;   

  • Other users on the platform in relation to your strata plan are referred to as the strata committee.  For the purposes of this agreement, the strata committee includes any role a strata plan decides to invite to the platform including strata managers and building managers; 

  • The online communications platform at hellostrata.com is referred to as the website. 

Creating a user account 

By creating a user account to access the website, you must ensure:

  • You are over the age 18 years; 

  • You are a legitimate representative of any strata plan you create and responsible for ensuring the legitimacy of any users you invite to join a strata committee; 

  • You only accept an invite to join an existing strata plan if you are legitimate member of that strata plan’s strata committee; 

  • You agree to keep your password safe and not share it with anyone else; 

  • You only use your user account and do not sign in with another user’s account. 

Acceptable usage 

In using the website, you must not: 

  • Post or transmit content on or through the website that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful or otherwise discriminatory, false or misleading, or incites an illegal act;

  • Intimidate or harass another through the website; and, you may not post or transmit any personally identifiable information about persons under 13 years of age on or through the website;

  • Manipulate user identifiers in order to disguise or misrepresent the origin of any communication; 

  • Duplicate, licence, sub-licence, publish, broadcast, transmit, distribute, perform, display, sell, rebrand or otherwise transfer information on the website;

  • Imply or state, directly or indirectly, that you are affiliated with or endorsed by us unless you have entered into a written agreement with us;

  • Infringe any patents, trademarks, copyright or other proprietary rights;

  • Install software, viruses, worms or any other computer code, files or programs that will or may interrupt, destroy or limit the functionality of the website;

  • Attempt to circumvent any security component included in or underlying the website.

Termination or suspension 

We may terminate, suspend or restrict your user account or access to specific strata plans with immediate effect for any reason or no reason at any time with or without notice.

Limitation of liability 

We do not provide any express warranties or representations. We exclude, to the extent permitted by law, all other terms, conditions and warranties which might be implied into these terms and conditions.

Without limiting the foregoing we are not responsible for and have no liability to you or your strata plan in respect of or arising from:

  • Any use or misuse of any information you provide or anyone else provides to or through the website;

  • Your failure to maintain accurate contact or other information in connection with your user account;

  • The delivery or non-delivery of any messages sent through the website;

  • Any interruption in the availability of or difficulties you may encounter in accessing the website (whether due to preventative or remedial website maintenance, system or network failures, acts or omissions of telecommunications or internet service providers or for any other reason);

  • Any discontinued service or loss of data from the website due to cessation of business for any reason. 

We are not liable for any loss of profits, loss of data, loss of revenue, loss of business opportunity or other head of damage commonly described as being ‘consequential’ or ‘indirect’ arising of the supply of the website to your strata plan or its use.

Intellectual property 

We reserve all of our intellectual property rights existing in the website and any services we provide through the website. These intellectual property rights include but are not limited to logos, trademarks, service marks and graphics.

Privacy policy

The Terms of Service as stated herein should be read in conjunction with our Privacy Policy outlined at hellostrata.com/privacy.

Changes to terms of service

We may change these terms of service at any time.  If so, we will notify you of the new terms of service via direct email communication to you.
